Employee Privacy Policy

Blue Bottle Coffee, Inc., on behalf of its affiliates and subsidiaries (collectively, “Blue Bottle,” “us,” “we,” or “our”) is committed to protecting the privacy and security of personal information that you provide in connection with your application for employment or employment with Blue Bottle as set forth in this Employee Privacy Policy (this "Employee Privacy Policy").  To proceed further with your application, please review this Employee Privacy Policy, its statements, terms and conditions carefully and sign any employment related agreements/acknowledgments.  If you have any questions regarding this Employee Privacy Policy, please contact People Operations at PeopleOps@bluebottlecoffee.com.

 

Failure of a team member to abide by this Employee Privacy Policy may result in disciplinary action including (without limitation) termination of employment.  Failure of prospective team members to agree to the terms of this Employee Privacy Policy may result in an incomplete job application.  This Employee Privacy Policy applies to any Employee Information that you provide as an employee of Blue Bottle, that is accessible on the Human Resources Information System (HRIS) system,  or that you provide to Blue Bottle through https://careers.bluebottlecoffee.com/. This Employee Privacy Policy is hereby incorporated into Blue Bottle’s employee Handbook and supersedes and replaces prior employee privacy policies and practices. 

 

1.    COLLECTION OF EMPLOYEE INFORMATION

If you submit an application for employment to or are currently an employee of Blue Bottle, Blue Bottle is authorized to collect the information in any form it obtains through your application for employment or continued employment with Blue Bottle, and your submission of employee related documents, including but not limited to the personal information that identifies, relates to, describes, or is capable of being associated with, a particular employee (collectively “Employee Information”).  Examples of Employee Information collected in connection with your employment or application for employment include but are not limited to your contact information, demographic, date of birth, government issued identification (passport, social security number, driver’s license number), banking information, marital status, health information, benefit information, pay, title, employment history, education, job qualifications, current or past job history, time away, performance evaluations, and other relevant employee personal data.  We also collect some of this information about your dependents when you provide it to us when you enroll in health and other benefits or provide contact information.  By providing personal information about family members or other individuals, you represent that you have their consent or authorization to provide this information to us for the purposes set forth in this Employee Privacy Policy.  Employee Information does not include any information that is available to the general public and excludes information generally available on a business card.

 

2.    SOCIAL SECURITY NUMBER

Blue Bottle will collect, use, store and retain, and secure your social security number in accordance with this Employee Privacy Policy.  Blue Bottle will not intentionally communicate or make available, in any manner, your social security number to the general public.  Blue Bottle will not print your social security number on any card required for you to access team member services provided by Blue Bottle.  Blue Bottle will not require you to transmit your social security number over the Internet, unless you otherwise consent, the connection is secure, or the social security number is encrypted.  We take reasonable security measures to try to prevent unauthorized access to your social security numbers.  Blue Bottle will not print your social security number on any materials that are mailed to you, unless state or federal law requires or permits the social security number to be on the document to be mailed.

 

3.    USE OF EMPLOYEE INFORMATION

In accordance with applicable law, Blue Bottle may use Employee Information in order to evaluate applications for employment, manage work-related aspects of the employee-employer relationship (i.e., training, payroll, assignment to customer contracts, benefits, travel, reimbursement expenses, performance appraisals, succession planning, employee health and safety), investigate and respond to any claims related to your employment, and comply with applicable laws and regulations.   

 

4.    SHARING OF EMPLOYEE INFORMATION

Blue Bottle retains service providers to perform certain human resources functions.  Blue Bottle may share your Employee Information with service providers acting on our behalf.   Blue Bottle requires that those third party service providers protect your Employee Information in accordance with this Employee Privacy Policy.  Blue Bottle may disclose your Employee Information if required to do so by law, governmental or quasi-governmental requests, or a regulatory organization, or to relevant third parties such as technicians, brokers, auditors, lawyers, or professional advisors (including, without limitation, providing Employee Information such as name and compensation information in connection with public filings and registrations required by applicable law and regulations, in connection with providing representations and certifications to Blue Bottle’s customers and vendors, and in connection with complying with and responding to security-related matters).  In the event that Blue Bottle considers it necessary to disclose Employee Information to protect the health, safety, or wellbeing of our employees, we may share Employee Information to prevent such harm.  We share Employee Information with companies that are affiliated with us (that is, that control, are controlled by, or are under common control with us). In addition, if we sell all or part of its business or make a sale or transfer of assets or is otherwise involved in a merger or business transfer, we may transfer Employee Information to a third party as part of that transaction, including at the negotiation stage.

 

5.    STORAGE AND DISPOSAL OF EMPLOYEE INFORMATION

Employee Information may be stored in hard copy or electronic format locally within the office of your employment as well as in the United States or other countries in which Blue Bottle, its affiliates, or service providers operate in.  Your Employee Information may be transferred into our HRIS system and used to manage your employment, may become part of your personnel file, and may be used for other work-related purposes.  Your Employee Information may be kept for as long as is legally required, and in some instances longer depending upon the needs of the organization and industry practices.  When such Employee Information is no longer needed to serve a legal or business purpose—subject to records retention requirements, any litigation hold, or other special situations that may require a longer retention period, Blue Bottle will destroy such records in a manner as to transform the record into an unreadable or indecipherable state that cannot be practically reconstituted. The following guidelines may be followed, depending on applicable legal requirements, when destroying such records: (a) paper records can be burned, pulverized, or shredded and, if shredded, they should generally be cross-cut to produce particles that are 1mm x 5mm in size, or smaller; (b) disposal of electronic records should be coordinated with the information technology department to ensure appropriate permanent disposal of electronic records and the information technology department may decide to consult third party standards conceding the use of various disposal systems (e.g., NIST Special Publication 800-88, Guidelines for Media Sanitization); and (c)  if a third party service provider is retained to destroy records, a written contract should be entered with the third party under which (i) the third party represents and warrants that records will be irrevocably destroyed in a manner that renders the records unreadable or undecipherable; and (ii) the third party shall implement and maintain reasonable security procedures and practices designed to prevent Employee Information from unauthorized access, use, modification, disclosure, or destruction.

 

6.    PROTECTION OF EMPLOYEE INFORMATION

We use reasonable security measures to help prevent Employee Information from becoming disclosed to individuals who are not described in this Employee Privacy Policy.  While we attempt to protect the information in our possession, no security system is perfect and we cannot promise that information about you will remain secure in all circumstances.

 

7.    ACCESS AND MODIFICATION OF EMPLOYEE INFORMATION

You can view most of your Employee Information by logging into your profile in the HRIS system any time.  It is the responsibility of each team member to promptly notify People Operations of any changes in Employee Information.  Personal mailing addresses, telephone numbers, number and names of dependents, individuals to be contacted in the event of an emergency, and other such status reports should be accurate and current at all times.  Most of this information, including direct deposit information, can be managed in the HRIS system.  If any of your Employee Information has changed, make the change in the HRIS and notify your manager and PeopleOps@bluebottlecoffee.com.

 

You may also contact People Operations to request access to your Employee Information so that you may confirm its accuracy, amend any inaccuracies, and update it as necessary.  In certain circumstances, you may also have the ability to restrict the use and disclosure of your Employee Information.  We will evaluate requests to access, restrict the use of, prevent disclosure of, or remove Employee Information, as required by applicable law.  In some circumstances we may not agree with your request to change your Employee Information and will instead append an alternative text to the record in question. 

 

8.    CONTACT AND DISPUTE RESOLUTION

If you have any questions regarding this Employee Privacy Policy or complaints regarding Blue Bottle compliance with this Employee Privacy Policy, you should first contact People Operations at PeopleOps@bluebottlecoffee.com.  We will investigate and attempt to resolve complaints and disputes regarding use and disclosure of your Employee Information in accordance with this Employee Privacy Policy.  If Blue Bottle needs, or is required, to contact you concerning any event that involves Employee Information about you, we may do so by email, telephone, or mail. 

 

9.    CHANGES

Blue Bottle reserves the right to change, amend, or alter this Employee Privacy Policy at its sole discretion.  Blue Bottle will publish and make available to you any revised, amended or altered Employee Privacy Policy and post the effective date at the bottom of this Employee Privacy Policy.  You are encouraged to regularly review our Employee Privacy Policy to keep up to date on our most current policies and practices.
